Appeals and Ministerial InterventionThe Migration Review Tribunal (MRT), Administrative Appeals Tribunal (AAT) and Refugee Review Tribunal (RRT), are independent merits review tribunals that examine “de novo” decisions made by the Department of Immigration and Citizenship (DIAC). This emans that the Tribunals examine the application from the beginning. The Australian Courts can, in turn, be asked to undertake judicial review of unfavourable decisions of the Tribunals named above. Our experienced team can assist with all aspects of merits review and judicial review, including advising on prospects of success. We can also advise and assist with the preparation of a submission to the Minister for Immigration and Citizenship to exercise his public interest powers (under the Migration Act 1958 (Cth)) and substitute the negative decision with a more favourable one. Resident Return VisasThe Resident Return visa allows current or former Australian permanent residents, or former Australian citizens to re-enter Australia as permanent residents traveling overseas.
