457 Nomination & Visa Application

The Nomination

The second part of the process of bringing a temporary worker to Australia is to apply for a NOMINATION.

The main criteria are that:
1.The position is for an occupation on the 457_List_of_occupations_July_2011.pdf 457_List_of_occupations_July_2011.pdf (390.23 KB).
2.The applicant is to be paid a TSMIT_July_2011.pdf TSMIT_July_2011.pdf (70.05 KB) which meets the threshold, which alters from time to time.
3.The Terms and Conditions of the employment are no less favourable than for an Australian in an equivalent position in the same location and the salary paid is at least at the  Market Rate.

All of the above can and do change and we are there to best navigate you through any of these changes to ensure compliance on the one-hand and the best migration outcome on the other. The nomination must meet the ANZSCO (Australian and New Zealand Classification of Occupations). We ensure that the correct occupation is nominated and that all the elements required are correctly described and provided to DIAC.

The Visa Application

The third part of the 457 visa process is to lodge a visa application for the sponsored employee.

It is imperative to show that:
1.The employee has the required skills to fill the position.
2.The employee meets the health requirements for the visa and holds suitable health insurance.

The 457 visa can be issued for up to 4 years, and extensions are possible. The length of the visa is decided by the sponsor. The 457 visa holder can only work for the sponsoring employer, unless a different employer lodges a new nomination for the employee. The visa can be cancelled if the employee ceases employment for more than 28 days, and the employee must maintain their health insurance cover.

The visa holder and family must provide quite detailed information to DIAC.  We liaise directly with the visa holder, provide checklists, explain what is required and ensure that the information provided to DIAC is accurate. The 457 visa holder is usually very stressed at the size of the move ahead. We minimise this stress by taking them through a step-by-step process and answering their questions. We can also provide an on-line relocation service which means that the visa applicant and family can source information about Australia, suburbs in the city they are moving to, resources they can utilise in their community such as hospitals, schools, housing etc. Before they arrive, they can feel confident about what to bring to Australia, where they would like to live, their children’s schooling and they can even set up bank accounts or lease their house.
