If you have fallen in love with an Australian/permanent resident, you may be eligible for one of the following visas. Same-sex and opposite-sex de facto couples in a genuine and continuing relationship are recognised as de facto partners in Australia.

Partner Visa – Onshore Temporary  
Subclass: 820
Eligibility: Must be married or in a de facto relationship with your partner
Duration: Valid for 2 years
Notes: This is a temporary visa which leads to a permanent visa after 2 years of genuine relationship with your partner. This visa allows you to work and study in Australia
   
Partner Visa – Onshore Permanent  
Subclass: 801
Eligibility: Must be married or in a de facto relationship with your partner
Duration: Valid for 5 years
Notes: This is a permanent visa which is granted if you are on a subclass 820 visa and have been in a genuine relationship with an Australian\permanent resident partner for at least 2 years. Some applicants may be eligible to go straight on to a subclass 801 visa without applying for an subclass 820.
   
Partner Visa – Offshore Temporary  
Subclass: 309
Eligibility: Must be married or in a de facto relationship with your partner
Duration: Valid for 2 years
Notes:
This is a temporary visa which leads to a permanent visa after 2 years of genuine relationship with your partner. This visa allows you to work and study in Australia.
   
Partner Visa – Offshore Permanent  
Subclass: 100
Eligibility: Must be married or in a de facto relationship with your partner
Duration: Valid for 5 years
Notes: This is a permanent visa which is granted if you are on a subclass 309 visa and have been in a genuine relationship with an Australian\permanent resident partner for at least 2 years. Some applicants may be eligible to go straight on to a subclass 100 visa without applying for a subclass 309.
   
Prospective Marriage Visa  
Subclass: 300
Eligibility: For people that are intending to marry their fiancé
Duration: Valid for 9 months
Notes: You must show your intention of marriage. Applications are processed at the nearest embassy. Once granted, you must marry within 9 months, after which you can apply for one of the partner visas.
